General Notes: Husband - Capt. Samuel Locke

Buried in McClary Cemetery, Epsom, NH, died at age 55. Another instance of not being recognised when he returned from several years in the Revolutionary War. He ran a tavern in Dover, and was guardian to his Cousin Abraham's children in 1805. His wife had dower rights to his property in Epsom, NH.

Many sources give name as William Samuel Lock, Locke genealogy gives that as his true name, but lists him as Capt. Samuel Locke.

From the Book of the Lockes by John Goodwin Locke, page 335 - "Samuel m. Mary Evans, resided at Epsom, kept a tavern. His will was proved May 15, 1816.

The History and Genalogy of Capt. John Locke, page 88. says he kept a tavern in Dover, and his wife had dower rights in his property in Epsom. Epsom town records records license for a tavern in Epsom.

NH Patriot 4-2-1816 CAPT. SAMUEL LOCKE - DIED '96 At Epsom, of the prevailing fever, Capt. SAMUEL LOCKE, aged 55; an honest man and a highly valued citizen; a soldier of the Revolution, and who had ever remained steadfast and immoveable in those principles which achieved & have preserved American Independence.

WILL of Samuel Locke 1814

In the Name of God Amen: I Samuel Locke of Epsom in the County of Rockingham and State of New Hampshire Gentleman being in good health of body and of a sound disposing mind and memory, considering the uncertainty of this life and being desirous to settle my worldly affairs while I have strength and capacity to do so, so make and publish this my last Will and Testament and therein and thereby dispose of all my worldly estate in manner following to wit:

First I give, devise and bequeath unto my son Samuel Locke Jr. all the land I own which was of the estate of Abraham Locke southeasterly of land owned by Moses Locke '96 also all the right and title I have to Mary Locke's dower in said Abraham Locke's Estate '96 also one half of my grist mill and saw mill and the privileges thereto belonging during his natural life '96 also the dwelling house he now lives in and the barn standing near it.

Second I give devise and bequeath unto my son Daniel Evans Locke all the land and buildings thereon I own in Epsom excepting what I have heretofore bequeathed to my son Saml Locke Jr., excepting a small piece of land situated between the Turnpike and Canterbury Road (so called) embracing the mill privileges. I give unto my son Daniel E. Locke one half of my grist mill and saw mill and the privileges thereunto belonging during his natural life '96 also the other half of my said grist mill and saw mill at the decease of my son Samuel Locke Jr - all my mills both grist and saw mills and the land situated between the road above mentioned are to descend to the children and children's children of my son Daniel Evans Locke forever.

Third I give devise and bequeath unto my wife Mary Locke, so long as she shall remain my widow, annually and every year sixteen bushels of Indian Corn, three bushels of Wheat, two bushels of Rye, one hundred weight of good beef, one pig, one pound of Souchong tea, one pound of Hyson tea, one pound coffee, one pound of chocolate, six pounds of sugar, ten pounds of flax, one peck beans, ten bushels potatoes, the keeping of two cows summer and winter '96 likewise four sheep, the increase the ci three barrels of cider to dispose of '96 my son Saml Locke Jr is to furnish for my wife eight bushels corn, one and a half bushels of wheat, one bushel of Rye, three barrels cider and six bushels of winter apples, one pound of Souchong tea and one pound of chocolate annually '96 the remainder of the fore mentioned articles are to be furnished unto my wife by my son Daniel E. Locke every year '96 all my stock and farming utensils I give unto my son Daniel E. Locke excepting two cows and sheep, I give unto my wife Mary Locke to whom I also give all my household furniture to be at her disposal excepting my clock which at her decease I give to my son Daniel E. Locke. Also I give unto my wife the west room and chamber over it and the west garret over it of my dwelling house as long as she shall remain my widow.

Fourth I give unto my daughter Betsy Brown one dollar

Fifth I give devise and bequeath unto my daughters Eleanor Locke, Polly Locke, Charlotte Locke, Ruhamah Locke, Irene Locke, Hannah Locke one hundred and fifty dollars each when they are married one hundred and fifty dollars to be paid by my son Samuel Locke Jr to my daughter Irene Locke, the other sums to my daughters are to be paid by my son Daniel E. Locke.

Sixth I give unto my grandson George Evans Locke when he is twenty one years of age, if he should live with me or my son Daniel E. Locke's family until that time, two hundred dollars, two suits of wearing apparel one suitable for working and the other suitable for the Lord's Day, six months schooling after he is fourteen years of age to be paid and furnished by my son Daniel E. Locke '96 I will that all my just debts be paid by my Executor.

Lastly I constitute and appoint my son Daniel Evans Locke Executor of this my last Will and Testament hereby revoking all former Wills by me made '96 In testimony whereof I the said Samuel Locke have to this my last Will and Testament set my hand and seal this first day of April A Domini 1814 '96

Mary Locke of Epsom in said county, Widow , that she is the widow of Samuel Locke late of Epsom Gentleman, deceased, that on the first day of April AD 1814 he the said Samuel Locke made and executed his last will and testament and on this 15th day of May AD 1816 Probate of said will was made before your Honor at a Procbate Court holden at said Epsom '96 that in said Will provision was made for he within of her right of dower in the Estate of her late husband which provision mentioned in said will she doth not consider as adequate to he right of dower in said estate. Therefore she the said Mary pray and honor to take caution and the advisor that she shall not accept the provision made in said will but that she shall claim her right of Dower in the lands tenements and personal property of the said Samuel Locke deceased

The conditions of the Above Obligations is such that whereas he the said Simon Godfree hath undertaken to support and maintain her the said Mary (his Mother) during her natural lifetime (or so long as she should remain a widow)-And to supply her with Meats Drinks Lodging and Cloathing-Doctoring and Nursing-And Convenient House room firewood & meaning[?] all the necessaries and Conveniencies of life-suitable to her advanced age in a word and be it understood that tis the true intent that she the said Mary shall be treated with all the tenderness and Dutyfull respect Due to One who has been an Indulgent and faithful Parent-And she to live on the Farm where she now Does- -
